What is twitter for the legal professional?

Twitter is an online social networking and micro-blogging service that enables users to send and read “tweets”, which are text messages limited to 140 characters. Registered users can read and post tweets, but unregistered users can only read them. Users access Twitter through the website interface, SMS or short message service, or mobile device.

It is best to view it as a micro-blogging service. It is headlines only. When you are viewing a twitter flow, you are really just scanning headlines. Some can be important. Others are much less important.

Twitter is immediate and some what ephemeral. It is the stream of consciousness of the entire twitter universe. It is a stream of headlines which makes it appear that things tweeted does not last long. Though it is hard to find a tweet from a few days ago, tweets are effectively permanent. Search tools can be used to extract them.

Twitter is an asymmetrical system. Anyone can follow anyone or jump in to a specific stream of tweets. Facebook and Linkedin are not asymmetrical. You and I have to be friends before we can see each others information.

e-discovery

Twitter is ripe for e-Discovery. As we will see there is virtually no privacy. Everything is fair game. Care must be taken of everything you tweet for yourself and the law firm. You need to carefully instruct your clients on how to tweet.

Tweet: I just told my lawyer what I did with all the money.

This is not a good tweet. Besides the lack of privacy, there are no retention dates. Everything stays out in twitter space for ever. This is a two edged sword. It can hurt you and/or your clients. It can be a great source of evidence against your opponent. Specific e-Discovery processes for using twitter are beyond the scope of this blog.

Ambient Intimacy

Ambient intimacy or ambient awareness is more than social media noise. It is the ability to keep in touch with people that you can’t otherwise because of time and space. It is saying “good morning” as you are walking down the hallway. You stay familiar with them by becoming away of the mundane issues of life.
Who wants this level of detail? Isn’t this all just annoying noise? There is great value in this ongoing noise. It helps us get to know people who would otherwise be just acquaintances that we would otherwise loose track. It makes us feel closer to people we care for but in whose lives we’re not able to participate as closely as we’d like.
Knowing details creates intimacy. It also saves a lot of time when you finally do get to meet face to face with these people in real life. It’s not so much about meaning, it’s just about being in touch.
Mikhail Bakhtin called it “the phatic function.” It is like saying “Good Morning” as you pass someone in the hall when you have no intention of finding out anything else. The phatic function is communication simply to indicate that communication can occur. It’s not so important what gets said as that it’s nice to stay in contact with people.
These light exchanges typify the kind of communication that arises among people who are saturated with other forms of communication. Another way to look at it is in child development. Out of sight out of mind: if the drops out of the baby, the baby forgets about it. By continuing to communicate in short bursts, those around us know we still exist: “Hi. I’m here and still practicing law”.

Gossip

Let’s face reality. Twitter is a great source of gossip. You find out in real time what a congressperson thinks of the State Of The Union message as it is being delivered. You can find out what your favorite movie star had for breakfast and if they liked it. You also find out which ones were busted for DUI in real time.

A natural caveat is that not all gossip is true on Twitter. You can say that about gossip in general. Though out history, gossip has been often untrue. That has never stopped anyone in history from gossiping. Gossip is also social glue that holds a group together. Currently that glue has nothing to do with distance. A particular community can be spread around the world.

Mind Reading

A well developed search can reveal how other people feel and view your firm and your self as a professional. The trending topics that appear on the search pge and change constantly give you insight into what a lot of people find important at any give moment. The search results update in real time. Mind-reading on twitter can increase your understanding. When you follow different people that yourself, you can gain valuable perspective on how they are different from you and your experience. Often you can see surprising patterns emerge allowing you to see the world differently.

To build relationships

Many people and firms (corporations and law firms) are using twitter to build relationship with clients and potential clients. Twitter is very interactive if you choose. The more information you push out the more people that you want to get to know, know more about you. Slowly in real time a relationship can be formed that could be mutually beneficial to both.

Customer Service Mechanism

Major corporations are using and monitoring twitter as part of the customer service. If they discover that people are making a specific complete about their service or product, they can quickly, in real time respond to the individual complainer. That response is also a response to anyone else that might have a similar problem or complain.

A means to meet new people

Twitter is a great way to meet new people and organizations without tripping over solicitation ethical issues. By being reasonably active on twitter and in this case pushing information about the firm and yourself, you will attract people interested in the same things you are interested in.

Conversational Device

It also doesn’t matter if you have personally met the one you are holding the conversation. Conversations are easily started and maintained.

To find out what your competition is doing

Twitter is a great way to keep tabs on what your competition is doing. Yes this also applies to the practice of law. The entire legal community is in a business competition with itself. With twitter, you find out in real time what they are doing.

To find out what your clients are doing

Twitter might be the only way you can find out what your clients are doing. It also includes potential clients and former clients. By monitoring twitter, you will witness when they have a life changing event. These include births, deaths, marriages, purchase of property, starting a new business venture. The law firm can then make informal contact with them to discuss potential will and trust changes, as an example.

Why Twitter for Lawyers? For Listening.

Why twitter?

Why twitter you may well ask. Isn’t there too many social media outlets? Why do I have to learn and do another one? What is the difference? Why use it?
It is true that there are many social media outlets. More are developed each day and all are a little different from each other. What makes twitter different is it use and how it should be used. Most social media is an opportunity for you the user to push out information about yourself, your firm and your interest. Twitter can be used for this and is being used for this. It is not the primary reason why you should use twitter.

Listening Device

Twitter works best when it is not viewed as a channel to push out information. With twitter you can listen to what everyone else is saying. You can focus on what individuals or firms are saying about anything. Twitter is immediate. You can easily find out what is of interest to your community of friends, associates, competitors or just plan celebrities ors and politicians. By using hash tags to search you can find out what is going on regarding a specific topic.

Headline Scanner

Twitter is a headline scanner. With it you can see what is the most important to the people using twitter. It could be major events such as a hurricane or earthquake. It is faster than any other news media in getting information out to the world. It was a neighbor down the street from Osama Ben Laden that first alerted the world that the Navy Seals were attacking. At the other extreme, a twitter user alerted the world that the TSA in Arizona were convinced that a drivers license from the District of Columbia was not a valid identification to use in airport security because the District of Columbia is not a state of these United States.

A caveat must be used at the same time. There is no absolute guarantee that what is tweeted is the truth. On the other hand, not all is what it seems even though it is mostly true. The selfy at the 2014 Academy Awards was not completely spontaneous. The next day the Wall Street Journal reported that the selfy was the result of a product placement by a cell phone manufacture that was also a sponsor of the program. It did successfully get publicity. The tweets and retweets brought twitter to its knees and most news organizations published articles on it and the selfy the next day. Even the Wall Street Journal article provided more publicity.
