Fees

2013 FEE SCHEDULE

DAILY RATE: $4,000 (In San Francisco Bay Area/Sacramento)

Four to six parties, add $400 to Daily Rate
More than six parties, add $800 to Daily Rate

This rate includes: 10- hours of time (usually about 8 hours of hearing time on the scheduled day and 2-hours reading and research)

Additional reading/research and hearing time, and calls may be billed, depending upon how extensive the time required, before and after the hearing at the rate of $400 per hour.

PREPAYMENT POLICY

All hearing fees are due upon receipt and must be received no later than 7 days prior to hearing.

If three days or more are reserved, hearing fees are due upon receipt and must be received no later than 30 days prior to hearing.

If the matter is scheduled within 14 days of hearing, all fees are due and must be received within 72 hours of invoicing.

Any additional fees incurred are due and payable upon receipt of the invoice.

Division of amount to be determined by parties involved but, for our collection purposes, it must be advanced in full by no more than four parties.

CANCELLATION/CONTINUANCE POLICY

Cancellation/Continuance Period Hearing Fee*

More than 35 Days from hearing: 100% REFUNDABLE

35 Days or Less from hearing: NON-REFUNDABLE if Mr. Strongman’s time cannot be refilled.

Canceling or continuing party responsible for hearing fees of all parties.

*Hearing fees are non-refundable for time which is scheduled and only partially used. For example, if a mediation of more than one day is concluded in less than the estimated time, there will be no refund or reduction of the invoiced fee. Hearings of 3 days or more are subject to 40 days advance notice cancellation/continuance policy.

MEDIATION FEE POLICY FOR COURT PANELS

In the interest of justice, Mr. Strongman provides mediation services for Court Panels at significantly reduced rates. The reductions of fees is not paid by the Court, but are donated by Mr. Strongman.

If the mediation is ordered by the presiding bench officer of a panel that Mr. Strongman is a member, then the local rules for reduced fee mediation will apply. Mr. Strongman is a member of the following Court Panels:

California Court of Appeal, First and Third Districts

Superior Court of California County of Alameda

Superior Court of California County of Contra Costa

Superior Court of California County of San Joaquin

Superior Court of California County of Solano

Once the reduced fee arrangement is met per the local rules, participants agree to pay Mr. Strongman’s fee for services rendered in the amount of $400.00 per hour. Fees are charged for time spent in preparation for the mediation (reviewing briefs/statements, site inspection, etc.), the mediation session, telephone calls and travel time if beyond Walnut Creek. Fees shall be shared equally by the Participants, unless a different arrangement is made.

Participants agree to make a deposit of $800 per party at least 10-days before the scheduled mediation. Any unused time will be refunded to the parties if the mediation takes place.

The said deposit will be forfeited and the canceling party(ies) will be responsible for the deposit if the cancellation of the mediation occurs less than five (5) days prior to the mediation unless the time scheduled can be re-booked.
